According to an article published by CNN, “Judge Paul Grimm of the US District Court for the District of Maryland said Friday that the program is to be restored to its ‘pre-September 5, 2017 status,’ meaning the status quo before President Donald Trump tried to terminate it, thereby giving hundreds of thousands of DACA-eligible immigrants the opportunity to apply”.
DACA stands for Deferred Action for Childhood Arrivals and allows people who arrived in the country as children to avoid deportation and receive temporary immigration status. After this decision, the Department of Homeland Security (DHS) will have to reopen the program.
So far, DACA recipients, also known as Dreamers, have been able to apply for renewal, but new immigrants who met the criteria could not apply. After this ruling, things will be changing for them.
“To be eligible, applicants had to have arrived in the US before age 16 and have lived there since June 15, 2007. They could not have been older than 30 when the Department of Homeland Security enacted the policy in 2012. Recipients are required to renew their protections every two years. The program doesn’t provide permanent protection or a pathway to citizenship”, the CNN article said.
However, it is still possible for the Trump administration to dismantle the program if they prove it was not done in a rushed manner and after taking into account all considerations. The administration has already made several attempts to shut down DACA and if they succeed, many people (around 800,000) would face deportation or would lose their right to work and legally live in the United States.
